Trump is in turmoil! In a decision on Tuesday, the Colorado Supreme Court ruled Trump is not an eligible primary candidate. You may be thinking, why is this Colorado case such a big deal? Well, Colorado, as well as various other states, have used the violation of the 14th Amendment to take Trump off of the ballot for the primary. This is the first time in US history the 14th Amendment has been used to take a President off of the Presidential Candidacy. The Insurrection that Trump committed was on January 6, 2021, in the attack on the U.S. Capital. The claims are that Trump’s speech “incited the crowd” said CNN News on January 6 not protected by the First Amendment.
The Colorado Supreme Court had the ruling four to three against Trump taking him off the ballot. The Colorado State Supreme Court’s decision will only apply to the Colorado ballet, but determining the ruling could be a heavy hitter with Trump voters on the ballot. The ruling, however, will be placed on hold until January 4, 2024, while Trump appeals the decision to the United States Supreme Court. All seven of the justices on the Colorado Supreme Court are appointed by the Democratic governors, six out of the seven juror’s won statewide retention elections to stay on the bench while the last juror was appointed in 2021 and has not faced the voters yet according to CNN News. Legal experts said, “The politically contentious Colorado case put the Supreme Court in a precarious and difficult position,” said BBC News.
Trump campaign spokesperson, Steven Cheung said in a statement. The Trump Campaign said on Tuesday they will “ swiftly file an appeal of the Colorado’s Supreme Court’s decision,” said CNN News. “The Colorado Supreme Court issued a completely flawed decision tonight and we will swiftly file an appeal to the United States Supreme Court and a concurrent request for a stay of this deeply undemocratic decision. We have full confidence that the U.S. Supreme Court will quickly rule in our favor and finally put an end to these unAmerican lawsuits,” Trump campaign spokesperson, Steven Cheung said in a statement. House Speaker Mike Johnson said in an interview that Colorado States Supreme Court’s decision was “reckless,” he also gave another quote saying, “Today’s ruling attempting to disqualify President Trump from the Colorado ballot is nothing but a thinly veiled partisan attack. Regardless of political affiliation, every citizen registered to vote should not be denied the right to support our former president and the individual who is the leader in every poll of the Republican primary.” Johnson, a longtime Trump ally who has endorsed the former president’s 2024 bid, said in the statement. “We trust the U.S. Supreme Court will set aside this reckless decision and let the American people decide the next President of the United States.” The Trump campaign also sent out emails to supporters asking for fundraising calling the act, election interference and asking for donations to “join the fight”.
Trump and his campaign are hoping the U.S. Supreme Court will overturn these allegations, so Trump will be in full effect come voting time.
